Hindu succession act 1956, in the section 6 and section 6A it is clearly mentioned that unmarried daughter are entitled to equal status of a coparcener. It also mentioned that the daughter are entitled to equal rights with son.
Before moving to the topic of this post will know some of the basic terms and there meaning according to law.
Who is unmarried daughter in hindu?
The definition of unmarried daughter is not exactly defined by statute but when we look section 21 of Hindu adoption and maintenance act it’s about dependent status.
Its sub Clause (v) his or her unmarried daughter, or the unmarried daughter of his predeceased son. Or the unmarried daughter of a predeceased son of his predeceased son, so long as she remains unmarried.
Devolution of interest in coparcenary property daughter
Section 6 of hindu succession act in a Joint Hindu family governed by the
Mitakshara law, the daughter of a coparcener shall.
- (a) By birth become a coparcener in her own right the same manner as the son.
- (b) Have the same rights in the coparcenery property as she would have had if she had been a son.
- (c) be subject to the same liabilities in respect of the said coparcenery property as that of a son.
- And any reference to a Hindu Mitakshara coparcener shall be deemed to include a reference to a daughter of a coparcener.
Equal rights to daughter in coparcenary property
Section 6A of Hindu succession act Equal rights to daughter in coparcenary property, in a joint Hindu family governed by Mitakshara law.
The section says that the daughter of a co-parcener shall by birth become a co parcener in her own right in the same manner as the son.
Daughter shall be subject to the same liabilities and disabilities in respect thereto as the son.

Coparcenary in Hindu family
Coparcenary is a smaller body within a Hindu Joint Family. It’s give a right by birth to a share in the joint family property in Hindu.
Before 2005, only male members of a Hindu Joint Family could be coparceners. It is governed by the mitakshara law in hindu family where ancestral property right by birth .
हिंदू अविवाहित पुत्री को संपत्ति में समान दर्जा प्राप्त है
The हिंदू उत्तराधिकार अधिनियम 1956 की धारा 6 और धारा 6ए में स्पष्ट रूप से उल्लेख किया गया है कि अविवाहित पुत्री coparcener के समान दर्जा प्राप्त करने की हकदार हैं। इसमें यह भी उल्लेख किया गया है कि पुत्री को पुत्र के समान संपत्ति पर अधिकार प्राप्त हैं।
हिंदू धर्म में अविवाहित पुत्री किसे कौन हैं?
अविवाहित पुत्री की परिभाषा कानून द्वारा स्पष्ट रूप से परिभाषित नहीं है, लेकिन जब हम हिंदू दत्तक ग्रहण और भरण-पोषण अधिनियम की धारा 21 को देखते हैं तो यह आश्रित(किसी के प्रति निर्भर रहना) स्थिति के बारे में बताया गया है।
धारा 21 उपखंड (v) उसकी अविवाहित पुत्री, या उसके पूर्व-मृत पुत्र की अविवाहित पुत्री, या उसके पूर्व-मृत पुत्र के पूर्व-मृत पुत्र की अविवाहित पुत्री, जब तक वह अविवाहित रहती है, उन्हें अविवाहित मना जा सकता है।
Coparcener संपत्ति में पुत्री के समान अधिकार
हिंदू उत्तराधिकार अधिनियम की धारा 6ए के अनुसार, मिताक्षरा कानून द्वारा शासित संयुक्त हिंदू परिवार में सहदायिक coparcener संपत्ति में पुत्री को समान अधिकार प्राप्त हैं।
इस खंड में कहा गया है कि किसी सह-भागीदार की पुत्री जन्म से ही पुत्र के समान ही अपने अधिकार से सह-भागीदार बन जाएगी।
पुत्री भी इस संबंध में पुत्र के समान ही दायित्वों और प्रतिबंधों के अधीन होगी।
