Speaker for the 2024, as General Election of India in which none of the party get the majority number to form the government.

Therefore the Coalition form of the government established means the parties came together to reach the majority number by supporting each other.

As we have gone through the above process how it take place in formation of government. In this general election 2024 the opposition also get more seats , the opposition is little bit number less than Coalition government.

Therefore there fight for speaker of lok sabha by members of Parliament, opposition wants to election of Lok sabha speaker.

This Speaker and Deputy Speaker of the house of the people election, after the oth and affirmation by pro tem Speaker to all the member of the house of people.

But this not happen, the voice noise louder side in favour or disfavour have given the preference and way to select the lok sabha speaker.

Deputy Speaker becomes vacant, the House shall choose another member to be Speaker or Deputy Speaker, as the case may be.

This means after the General election of Lok sabha there shall be Speaker and Deputy Speaker chosen by the member of house of people.

The seat of speaker and Deputy Speaker shall not be vacant, reappointment and elect the speaker and Deputy Speaker after immediate of vacant seat.

Pro tem Speaker of Lok sabha or state legislative

Pro tem Speaker is the senior most member of the house of people elected by President in the first meeting of the Parliament, and by Governor in State.

It is Temporary speaker appointed for a limited time period to conduct proceedings in Parliament or State legislatures. 

The pro tem Speaker is Temporary Speaker till the appointment of Speaker and Deputy Speaker of Lok sabha.

Constitutional provision of appointment of Lok sabha speaker’s

When we go through Constitution the Article 93 talks about the appointment of Lok Sabha speaker and Deputy Speaker through simple majority, by the member of house of the people.

As according to Constitution Article 93 of Indian Constitution, it talk about the appointment of speaker and deputy speaker.

The speaker and Deputy Speaker shall be the member of the house of people and after nomination and appointment it shall not remain the party member from which party it belong to.

When we go through the Construction Article 93– The House of the People shall, as soon as may be, choose two members of the House to be respectively Speaker and Deputy Speaker there of and,

So often as the office of Speaker or Deputy Speaker becomes vacant, the House shall choose another member to be Speaker or Deputy Speaker, as the case may be.

This means after the General election of Lok sabha there shall be Speaker and Deputy Speaker chosen by the member of house of people.

The seat of speaker and Deputy Speaker shall not be vacant, reappointment and elect the speaker and Deputy Speaker after immediate of vacant seat.

Power of Speaker and the deputy Speaker

The house of the people, shall have a Speaker and Deputy speaker , the power vested as according to the Constitution.

The speaker and Deputy Speaker has appointment to function and regulated the Parliament Lok sabha proceedings smoothly.

This speaker and Deputy Speaker are the protector of right and Privilege of the member of the house of people and can be called as the Guardian of the member of the house of people.

The final matters decision discussed in the house of the people shall of the speaker.

  • Constitution of India.
  • The rules of procedure of conduct of business of Lok Sabha.
  • Parliamentary convention.

Article 95 of the Constitution talks about the power and function of the speaker.

Article 95 of the Indian Constitution

The power of deputy speaker or other person to perform the duties of the office of, or to act as, speaker.

  • 1) While the office of the speaker is vacant ; the duties of the office shall be performed by the Deputy Speaker.
  • or, if the office of the Deputy Speaker is also vacant, by such member of the House of the People as the President may appoint for the purpose.
  • 2) During the absence of Speaker from any sitting of the House of the People the Deputy Speaker or,
  • if he is also absent, such person as may be determine by the rules of procedure of the House, or,
  • if no such person is present, such other person as may be determined by the House shall act as a Speaker.

Duties of the Lok sabha speaker

  • To maintain the decorum of the house of the people and function of the Parliament Lok Sabha proceeding so, that the proceeding process systematically.
    • This is the most prime responsibility be performed by the lok sabha speaker and it, he has absolute power.
  • He / she has the power to adjourned or to suspend the house of the people proceeding.
    • If usually the attendance of the house is less than 55 members means 10% less than total strength member present .
  • He cast his vote as member of lok sabha, when it deadlock means equal voting on any special decision, to break the deadlock, voting by casting his vote and that called as casting vote. (Article 100(2)).
  • When the President called joint meeting of both the houses on deadlock situation, then there the chair held by speaker of lok sabh.
  • As we know that money bill cannot introduce in Rajya sabha, it can only in lok sabha.
    • The decision either it is money bill or not decided by speaker.
  • When it come disqualification or suspension of the member of the Parliament House of the Lok Sabha then the Speaker has its final decision either to disqualify or remain.
    • But the decision may go for Judicial review.

In absence of the Speaker the Deputy Speaker shall act and perform their duty.

Tenure of the Speaker

Generally the tenure end after 5 year but it still remains, till the election and appointment of New Speaker after the General elections.

It may also go for the recontest for the election of the Lok sabha speaker.

Salary and allowances

  • The salaries and allowances as may be respectively fixed by the Parliament by law.
  • Salaries are paid through the consolidated fund of India.
  • Allowances and salaries are as specified in the second schedule of the constitution.

Removal or resignation of Speaker and Deputy Speaker

  • By writing under his hand address at any time, if he is Speaker then written letter of resignation given to Deputy Speaker.
    • If he is Deputy Speaker then given to Speaker.
  • May be removed, by resolution passed by majority of the member of lok sabha.
    • 14 days notice given of the intention to move the resolution of removal. (Article 94).
