Up land revenue code 2006

Introduction

There are total 16 chapter, 234 section and 4 schedule in this up land revenue code 2006 assent on 29 Nov 2012, and enforcement from 18 Dec 2015 and rest all left section from 11 feb 2016.

There were many laws regarding land tenure, land revenues in Uttar Pradesh they create confusion and inconsistent to provide speedy justice.

Therefore the codification were done by the up legislature to simplify and to come out the confusion of different laws and formulated the up revenue code which apply to whole Uttar Pradesh.

The statutes provide the following numbers of chapters, sections and schedule are as:-

This up land revenue code is Act no. 8 of 2012 assent on 29 Nov 2012 and took long journey for its enforcement some section enforced from 18 Dec 2015 and rest from 11 feb 2016.

Section 1 of Uttar Pradesh land revenue

Short title, extend and commencement of Uttar Pradesh land revenue 2006

Section 1(1) of the up land revenue code provides short title which means this act may be called the Uttar Pradesh revenue code.

This section 1(2) of Uttar Pradesh revenue code also provide extend to which this code applies it’s jurisdiction, as it applies to whole Uttar Pradesh.

Applicability of the code, section 2 uttar pradesh land revenue

• Shall apply to Whole Uttar Pradesh
• Except chapter VIII and IX
  • VIII- Management of land and other properties by Gram panchayat or other local authority. Section 59 to 73.
  • IX – Tenure (rights) Section 74 to 146.
• Specified at serial number 19 and 20 of the first schedule of their repeal by this code and apply chapter VIII- and IX.
  • 19- up zamindari abolition and land reform act 1950.
  • 20- the Rampur stay of ejectment suits and proceeding 1951.

Up land revenue section 2

This section 2 of UP land revenue Court 2006 States the applicability of the code.

The provision of the code except chapter 8 and 9 shall apply to the whole of up and 8 and 9 shall apply to the area to which any of the enactment specified at serial number 19 and 20 of the first schedule was applicable on the date immediately preceding their repeal by this code.

Extent of the code to new areas Section 3 of Uttar Pradesh land revenue

This section 3 of Up land revenue code 2006, extend of the code to new areas added to the territory of Uttar Pradesh.

• After the commencement of this code, if new areas are added to the territory of Uttar Pradesh.
• State government May by notification extend the whole code or any of its provision to the new area.
  • Means state government specified either whole code is applicable or certain code is applicable by notification.
• State government May also modify, amend or alter such above notification.

Objective of Uttar Pradesh land revenue code 2006

The Objective of Uttar Pradesh land revenue code to consolidate or to collection of those law which are already passed in a particular aspects.

  • Land tenure.
  • Up zamindari abolition and land reform act 1950.
  • Up land revenue act 1901.
• To simplify the legal rules procedure of revenue matters.
• To speedy up the disposal of revenue case by creating Revenue Courts.
