When Copyright infringed section 51 of the copyright act says, copy without license, breach of license, piracy of work, trade exhibits of work etc.
Idea can be copy means inspiration can be obtain, but expression not. If expression is copied then it is copy and infringement of copyright work.
Infringement means in general to overlap, to copy, to violates. There is no any specific definition provide in the copyright act.
When Copyright violation we say, it infringement of the work.Here infringement means that, if someone has legitimate copyright given by law.
And if someone wants to create something out of this work. They have two option either by inspiration derivative it or get license to reproduce it.

In this case S.K. Dutt v/s law books co. The Allahabad High court, states that, several person may original similar work in same general form. Form without infringing the law of copyright. Infringement is when someone has instead of utilizing his skill has just made a copy.
Without license, Copyright infringed
Section 51(a) of the copyright act India, the infringement of copyrights without or with condition of license granted. It is primary act of infringement.
- When any person without a license granted by owner of copyright, Or by registrar of copyrights. Does anything the exclusive right of owner of copyright conferred by act.
- License granted contravention (breach) with condition imposed by authority or owner under this act.
- Example, the license is granted for to make only cinematograph work, but you making along with it, dramatic work. This is infringement of term of copyright assigned.
Piracy of the original work, Copyright infringed
This Piracy is secondary act of infringement of copyright work. In this when any person makes means copy the work for sale, or hire to sale, or let’s for hire. Here lets for hire is that is open for lease, or by way of trade display.
Make copy for distribution either for purpose of trade or to such an extent as to affect prejudicially owner.
Extent means for example, if you buy a movie CD/DVD, or pendrive for your private watch. In this private, includes your families member or friends. But at same time you open this to all persons of your society, neighborhood etc. to watch the movie.
Here owner in loss as because CD DVD or pendrive that he may sale and get more profit of it, you affect it by extent. As the person who may buy the movie, after your effect they will may not buy as not interest they have in further.
The extent prejudice the owner of the copyright.
The Piracy by any person by way of trade exhibits in public, imports into India any infringing copies of the work. Import in India for commercial purpose any copyright work, it for not one copy which is for domestic and private use of the importer.
When Any place permits for profit of work without license of copyrights
Section 51(a)(ii) of copyright act, any person permits any place to be use for communication of copyright work for profit without owner permission or knowledge. That it is an infringement of copyright work as the owner has exclusive right by law on it.
Example, When anyone buy or taken subscription of any movies name ABC. The subscription is only of private use, but he displayed the movie on Screen at his house, ₹ 50 pay and watch movie.
Here the subscriber is infringing the copyright work, as he affect prejudicially the owner of copyright.
By way of trade exhibits in public, infringement of copyright
Section 51(b)(iii) of the copyright act, when any person by way of trade exhibits in public, copyright work is infringement.
Example, A bring a Movie CD, (its for private extent use only). But it exhibits by projector or by other devices to public by selling ticket to show it.
Here the infringement of copyright work, as the owner has economic loss and prejudice the copyright of owner.
Prejudice because the maximum profit he may but by this most people who had watched, will not bring there interest to purchase this CD.
Infringing copies of work by import, Copyright infringed
Section 51(b)(iv) of copyright act, when any person import any copy of any work for private and domestic use. Till then it not infringement.
But when person means importer makes copies of it and start economic benifit from it. Then it infringement of copyright work that the importer imported.
Example, A book that is not available in India and a copy of it imported from England. The import is only for private , but when it convert private to economic, then infringement of Copyright. Because he does not have any license of the work, only he is consumer of the owner work.
The proviso of section 51(b)(iv) says that nothing in sub Clause iv shall apply to the import of one copy of any work. The work for private and domestic use of the importer.
What is derivative work in copyright?
In general term the meaning of derivative is something that is derived from based on something else. When you inspire by any work that already exist, may be the idea to create own new work. Own work here is that you add and able to do creativity with your own expression.
Idea may same but you have put your originality of work in it.
Reproduce of copyright, Copyright infringed
Reproduction means, the work already in extension and you copy it as it same by reproducing it. It is different from derivative work as it is in license assigned to copy.
While in derivative the creativity is add by inspiration of work already in extension not expression.
Hypothetical Example, Spiderman is character in cartoon, when it is in paper it Artistic work. When it get in film it become cinematograph, It is itself an copyright character on its own of DC comics.
It may be Marvel who may be inspired by something. Because DC comics was running since a long time before Marvel all character.
In India chacha chaudhary comics was vey famous cartoon character when it films.
