Custodial death Summary of the case is that father-son in Tamil Nadu during Covid 19 apprehended by police due to lockdown they were opened there shop.

In police station at Sathankulam Tamil Nadu they were detained and harassed, brutal beaten continuously which causes to death of both.

This incident of abuse of police authority had shaken the Conscience of society. Due to public outrage and media coverage of fair investigation a case registered at Kovilapatti police station.

The Tamil Nadu Government transferred the Case to CBI for fair and transparent investigation. CBI registered two case against the police official on the request of Tamil nadu Government to central Government.

Charges under IPC 1860 section 302, 201, 120B, 342, 182, 193, 211, 218 and 34 against 9 police official persons.

The district court of Madurai awarded death penalty to all 9 convicted police official, Case CBI vs. Sridhar, SC No. 470/2020 decided on 6/4/2026.

Rarest of rare doctrine case, Custodial death

This doctrine rarest of rare coined in 2 case Bachan singh vs state of punjab 1980 and Machhi singh vs sate of punjab 1983.

There is no any statutory definition of rare of rarest it calculated on the basis of facts, circumstances, brutality of crime, conduct of person.

Generally, Courts award life imprisonment to convict in a murder case. Only in rarest of rare cases murder convicts are given death penalty.

पुलिस हिरासत में मौत, पुलिस अधिकारी को मौत की सजा

मामले का सारांश यह है कि तमिलनाडु में कोविड-19 के दौरान लॉकडाउन में दुकान खोलने के कारण पिता-पुत्र को पुलिस ने गिरफ्तार कर लिया।

तमिलनाडु के साथनकुलम स्थित पुलिस स्टेशन में उन्हें हिरासत में लिया गया और प्रताड़ित किया गया, लगातार बेरहमी से पीटा गया जिसके कारण दोनों की मौत हो गई।

पुलिस के अधिकार के दुरुपयोग की इस घटना ने समाज की अंतरात्मा को झकझोर दिया था। जनता के आक्रोश और निष्पक्ष जांच की मीडिया कवरेज के चलते कोविलापत्ती पुलिस स्टेशन में मामला दर्ज किया गया।

आईपीसी 1860 की धारा 302, 201, 120बी, 342, 182, 193, 211, 218 और 34 के तहत 9 पुलिस अधिकारियों के खिलाफ आरोप लगाए गए हैं।

मदुरै की जिला अदालत ने सीबीआई बनाम श्रीधर मामले में सभी 9 दोषी पुलिस अधिकारियों को मौत की सजा सुनाई, सुप्रीम कोर्ट संख्या 470/2020, फैसला 6/4/2026 को सुनाया गया।
